JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Siwan Muffasil (Mahadeva) P.S. Case No. 08 of 2016 for the offence instituted under Sections 341, 323, 448 and 307/34 of the Indian Penal Code.

The allegation against the petitioner is that he along with other co-accused assaulted the informant and when his wife and son came for rescue, they were also assaulted by the accused persons, causing injury to them.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties

Patna High Court Cr.Misc. No.50788 of 2016 (2) dt.25-11-2016 2/2 vide Annexure-4 to the present application. The other co-accused have been granted anticipatory bail vide Cr. Misc. No. 33430 of 2016 and Cr. Misc. No. 37528 of 2016.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today, in connection with Siwan Muffasil (Mahadeva) P.S. Case No. 08 of 2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
