This is an application for grant of anticipatory bail in connection with Madhepura P.S. Case No. 649 of 2015 registered for the offence punishable under Sections 341, 323, 325, 307, 379, 354-A/34 of the Indian Penal Code. The allegation against the accused persons is assaulting the informant resulting in grievous injury on the person of the informant.
The learned counsel for the petitioner submits that the main accused in the present case is Chhhote Mukhiya who is the person who had assaulted the informant resulting in grievous injury and he has already been granted regular bail. It is further submitted that as far as the petitioner herein is concerned, no
Patna High Court Cr.Misc. No.10095 of 2018(2) dt.20-02-2018 2/2 allegation of any specific assault has been levelled and he is having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 649 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
