The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. It is alleged that from the shop of the petitioner 27,800 ml. Bear and 13000 ml. country made liquor were recovered.

It is submitted by learned counsel for the petitioner that the place of seizure does not belong to the petitioner and on suspicion the petitioner has been roped in the present case. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.55270 of 2015 (2) dt.07-12-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Aurai P.S. Case No. 157 of 2015, pending before the learned Judicial Magistrate, 1st Class, Muzaffarpur. With the above observation, this application is, accordingly, disposed off.
