JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 313 of 2017, disclosing offences under Section 498A of IPC and Section 4 of Dowry Prohibition Act.

Allegation as per complaint petition against the petitioner is that petitioner was married with opposite party no.2 but from the very beginning, there was no good relationship between them and the petitioner always torturing her in different ways and was demanding Rs.1,00,000/- and lastly he ousted her from the house by snatching her ornaments and other articles. Submission of the learned counsel for the petitioner is that from the very beginning she was not interested in residing with the petitioner and he has falsely been implicated in this

In this case, earlier notice was issued to the opposite party no.2 and the same has been received by the opposite party no.2, personally, which will appear from the report of service and even on the last date, she has not appeared and as such, in the interest of justice, the matter has been posted for today. Today also nobody appears on behalf of the opposite party no.2.

In such view of the matter, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sub Divisional Judicial Magistrate, Arwal, in connection with Complaint Case No. 313 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that if the opposite party no.2 is still ready to reside with him, he is to keep her with dignity and care.
