JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-10-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Allauli Police Station Case No. 165 of 2016, disclosing offences under Sections 364/302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959. Considering the gravity of the offences and the fact that the role of the petitioner cannot be ruled out, who is named in the First Information Report, I am not inclined to grant the petitioner privilege of anticipatory bail, taking into account Supreme Court's decision, in the case of Jai Prakash Singh v. State of Bihar and Another, reported in (2012) 4 SCC 379.
This application for anticipatory bail, is hereby,
Patna High Court Cr.Misc. No.42279 of 2016 (2) dt.05-10-2016 2/2 rejected.
The petitioner, Rajendra Yadav, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
