ANJANA MISHRA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Parsa P.S. Case No.110 of 2016 for allegedly having committed the offence under Sections 272 & 273 of the Indian Penal Code and Section 47 of the Excise Act. Learned counsel for the petitioner submits that neither the petitioner was the owner of the car nor was any liquor recovered from his conscious possession. It is further submitted that two of the co-accused persons arrested from the car had taken the name of the present petitioner and as such, the petitioner is apprehending his arrest.

No.41712 of 2016 (4) dt.23-11-2016 2/2 recovery from his conscious possession, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, 9th, Saran at Chapra, in connection with Parsa P.S. Case No.110 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
