JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Mukesh Kant, learned counsel for the petitioner and Sri Narsingh Tanti, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in G.B.Nagar P.S. Case No.152/2017 registered for the offence under Sections 272/273/308 of the Indian Penal Code and Sections 30/36/38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that save and except suspicion, there is no material against the petitioner. He submits that nothing was recovered from the conscious possession of the petitioner and the petitioner, though, was made accused earlier in G.B. Nagar P.S. Case No.45/2017, but it was case registered for the offence under Sections

Patna High Court Cr.Misc. No.46515 of 2017(2) dt.17-10-2017 2/2 341/323/504/34 of the Indian Penal Code. He further submits that the petitioner is having no criminal antecedent relating to offence under the Excise Act.

Considering the fact that the petitioner has been made accused only on suspicion and nothing was recovered from his conscious possession, let the petitioner, namely, Kamta Prasad Singh @ Bhutur Singh @ Bhutu Singh, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with G.B.Nagar P.S. Case No.152/2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) nawalkrs/- U T
