2. The petitioners apprehend their arrest in connection with Chandi P.S. Case No. 31 of 2025 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. 250 litres of country made liquor was recovered from the bamboo clump. The petitioner has been made accused on the basis of suspicion.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. He further submits that nothing has been recovered from the possession of

Patna High Court CR. MISC. No.29341 of 2025(2) dt.07-05-2025 2/2 the petitioners. Petitioner No. 1 has got one criminal antecedent in which he is on bail. Petitioner No. 2 has clean antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within eight weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1st, Bhojpur at Ara in connection with Chandi P.S. Case No. 31 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
