JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,504,325,427,379 and 307 of the Indian Penal Code.

The prosecution case is that the petitioner assaulted with iron rod to Suraj, the nephew of the informant causing uprooting of tooth.

It is submitted by the learned counsel for the petitioner that for the occurrence of 1.7.2015 the fardbeyan of the informant was recorded on 7.7.2015 which came to registered as police case on 13.7.2015 whereas uncle of the petitioner namely Nand Kishore Prasad lodged Paraiya P.S. Case No. 58 of 2015 against the informant and his other family

Patna High Court Cr.Misc. No.55247 of 2015 (2) dt.07-12-2015 2/2 members on 1.7.2015 itself. The injury report of Suraj suggests two lacerated injuries of which one was found to be grievous. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the case lodged by the petitioner side at earlier point of time, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya in connection with Paraiya P.S. Case No.71 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
