2. In this case, the petitioner is seeking regular bail in connection with Goraul P.S. Case No. 398 of 2023, registered for the offences punishable under Sections 395 & 397 of the Indian Penal Code & 27 of the Arms Act.

3. As per allegation, the informant was sitting at his grocery shop and at that time, all of sudden 6 miscreants borne on two motorcycles without number came there and out of then, four miscreants entered into his shop whereas two miscreants remained standing outside the counter. They put revolver in the temple of the informant and looted away about Rs. 20,000/- from the cash box, Rs. 80,000/-,kept in the bag and some documents and started fleeing away. The informant's neighbour tried to chase the miscreants but the miscreants fired on him,

Patna High Court CR. MISC. No.24876 of 2025(2) dt.01-05-2025 2/2 which hit on his right shoulder and he became injured. All the miscreants fled away by opening fire in the air.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is not involved in any other case of similar nature and his name has figured in confessional statement of co-accused, who has been granted bail. The petitioner is under custody since 13.12.2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Vaishali at Hajipur in connection with Goraul P.S. Case No. 398 of 2023, subject to the condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
