The petitioner is apprehending his arrest in connection with Sour Bazar P.S. Case No. 195 of 2015 for the offences instituted under Sections 147, 149, 341, 323, 324, 307, 504 and 506 of the IPC.
As per the prosecution case that on 15.06.2015 while the informant was sitting at his Darwaja with his wife Manju Devi, then co-accused Amit Kumar was going with his bicycle, which he demanded the motorcycle but the co-accused Amit Kumar refused to hand over his bicycle and then there has been exchange of abusive language between them and assaulted the informant with lathi, danda.
Patna High Court Cr.Misc. No.57891 of 2015 (2) dt.10-03-2016 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is a case and a counter case between the parties. From perusal of Annexure-4 to the supplementary affidavit, it is evident that the matter has been settled between the parties.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sour Bazar P.S. Case No. 195 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri B.K.Singh, Judicial Magistrate, Ist Class, Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
