JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 329, 504 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioner came variously armed and started abusing the informant. On protest being made the accused persons dashed the informant on the ground and assaulted with fists and slaps. When the wife of the younger brother of the informant came to rescue then petitioner assaulted with dab causing injury on the head. It is further alleged co-accused Awadhesh Singh took out gold chain from the neck of Sanju Devi.
It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled and Title Suit No. 9 of 2014 is
Patna High Court Cr.Misc. No.56496 of 2015 (2) dt.17-12-2015 2/2 pending between the parties.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the genesis of occurrence and petitioner having no criminal antecedent, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Bidupur P.S. Case No. 143 of 2015, pending in the Court of learned Chief Judicial Magistrate, Vaishali at Hajipur. With the observations above, the application stands disposed off.
