This application is for grant of regular bail in connection with Tr. No.41 2017 of for the offences under Sections 376 of the Indian Penal Code.

Allegation against the petitioner is of committing rape with a minor deaf and dumb girl.

Submission of the learned counsel for the petitioner is that medical report does not support the prosecution case. Petitioner is in custody for more than 1 1⁄2 years.

Heard learned A.P.P. and it appears from the order sheet that seven witnesses have already been examined the learned trial court has supported the allegation. . Having heard both sides and considering the same,

Patna High Court CR. MISC. No.25935 of 2019(5) dt.25-02-2020 2/2 I am not inclined to grant bail to the petitioner . However, learned trial court is directed to conclude the trial preferably within six months, otherwise petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
