JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 470 of the Excise Act. Allegation in brief is that the excise officials raided the hut of the petitioner and recovered 70 litres of illicit country made liquor.

It is submitted that the premises does not belong to the petitioner, though there is specific allegation that it was recovered from her and he had escaped from there.

Having considered the said facts and circumstances, I do not find it a fit case for grant of anticipatory bail. So the prayer for anticipatory bail of the petitioner is rejected. However, the petitioner, if so advised, may surrender before the court below and

Patna High Court Cr.Misc. No.54868 of 2016 (4) dt.10-02-2017 2/2 seek regular bail, the same shall be considered on merit without being prejudiced by this order.
