Learned counsel for the petitioner is expected to honor his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon.
The petitioner seeks bail in Muffasil P. S. Case No 399 of 2018 instituted for the offence under Section(s) 341,323,307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier, prayer for anticipatory bail of the petitioner has been rejected by this Court vide order dated 09.04.2019 passed in Cr Misc No 22489 of 2019.
Patna High Court CR. MISC. No.27337 of 2020(2) dt.22-01-2021 2/3 The allegation is that while the informant was fishing on the river, he was shot at by the two named accused persons, including the petitioner.
Learned counsel for the petitioner submits that the FIR is belated. The same has been lodged on 12.11.2018 in respect of allegation dated 10.10.2018 though it is alleged that two persons fired, only one firearm injury has been found that also on the leg below the knee of the informant. The petitioner is in custody since 21.05.2019. He is on bail in some of the cases mentioned in paragraph no 3 and acquitted in some of them. The learned APP opposed the prayer for bail.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Munger, in connection with Muffasil PS Case No 399 of 2018, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
