JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-10-2016 Heard learned counsels for the petitioners and the State. The petitioners being parents, brothers, sisters and brother in laws (Bahnoi) of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A,323 and 325/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioners that the accusation of making assault is omnibus and general. Three injuries have been found lacerated, swelling of marginal size, incised, superficial simple in nature. The thrust of acusation

Patna High Court Cr.Misc. No.46539 of 2016 (2) dt.24-10-2016 2/2 is against the husband of the informant and the petitioners claim to be separate from the husband of the informant. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Saharsa in connection with Saharsa Mahila P.S. Case No. 28 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
