JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
While travelling in the train, the informant's bag having mobile phone, ATM card and other things, was stolen, subsequently the stolen ATM of the informant was misused and `30,000/- was withdrawn from the same and the SIM card registered in the name of the informant was also used. It is submitted by learned counsel for the petitioner that even assuming the accusation, the offence under Section 379 IPC is not made out against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.56367 of 2015 (2) dt.11-12-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with GRP (DBG) P.S. Case No. 06 of 2015 pending in the court of learned I/C Railway Judicial Magistrate, Samastipur.
Accordingly, the application is disposed of.
