This application for grant of bail arises out of Nabinagar P.S. Case No. 88 of 2018, disclosing the offence under Section 379 of the Indian Penal Code.

Petitioner had earlier approached this Court for grant of regular bail by filing an application giving rise to Cr. Misc. No. 66578 of 2018, which was rejected by order dated 03.12.2018 with observation that petitioner shall be at liberty to approach this Court after three months if, in the meanwhile, there is no progress in the trial.

Learned counsel appearing on behalf of the petitioner has submitted that there is no visible progress in the trial. Considering the above submission, this application is

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned CJM, Aurangabad in Nabinagar P.S. Case No. 88 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
