The petitioners apprehend their arrest in connection with Mahua P. S. Case No. 94 of 2017 instituted under Sections 304B/34 of the Indian Penal Code.
The allegation, in brief, is that daughter-in-law of the petitioners was burnt to death in connection with demand of dowry and her dead body was found in burnt condition at the gate of the house.
Learned counsel for the petitioners submits that petitioners were not present at that time in the house as they had gone to attend shradh ceremony in the village. Having considered aforesaid facts and circumstances
Patna High Court Cr.Misc. No.37800 of 2017 (2) dt.11-08-2017 2/2 as well as the nature of offence, prayer for anticipatory bail of the petitioners is hereby rejected.
However, if the petitioners surrender in the court below and seek regular bail, the same shall be considered on its own merit without being prejudiced by this order. (Arun Kumar, J) Sujit/- U
