The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 376, 504, 506, 509, 493, 34 of the Indian Penal Code and Sections 4/6 of the POCSO Act.
As per prosecution case, the allegation against the petitioner is that he committed rape with the informant's daughter and made video of the alleged offence and on the alleged video he committed the offence several times. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal
Patna High Court CR. MISC. No.26981 of 2023(3) dt.24-07-2023 2/2 antecedent. It is further submitted that the petitioner is languishing in judicial custody since 19.04.2022. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner has committed rape with the informant's daughter. As per the statement of the victim recorded under Section 164 of the Cr.P.C., which is annexed with case diary wherein, she has specifically stated against the petitioner of rape and making of video without her consent.
Having heard the learned counsel for the parties and considering the fact that there is direct allegation against the petitioner of commission of rape to the informant's daughter, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
The trial Court is directed to expedite the trial and conclude the same as soon as possible.
