2. The petitioner has prayed for bail in connection with Janki Nagar P.S. Case No. 05 of 2025, registered for the offence punishable under Sections 8(c) and 21(b) of the NDPS Act, 1985.
3. The case of the prosecution is that the police on the basis of secret information raided the house of co-accused Vishal Kumar and recovered 11.5 gm of Smack/Brown Sugar from his conscious possession, the name this petitioner surfaced on the statement of Vishal Kumar. Vishal Kumar disclosed that the petitioner has supplied the contraband to him. The learned counsel for the petitioner has further submitted that in this case
Patna High Court CR. MISC. No.29306 of 2025(2) dt.19-05-2025 2/2 the recovery has been made from Vishal Kumar and nothing has been recovered from the possession of this petitioner.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is languishing in judicial custody since 13.01.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedents of three cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea, in connection with Janki Nagar P.S. Case No. 05 of 2025.
