JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Mahila P.S. Case No. 39 of 2017 corresponding to G.R. No. 2454 of 2017 registered for the offence punishable under sections 376, 504, 506/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that some negotiation was going on with the family members of the informant for marriage with this petitioner. Petitioner refused the marry as he do not want to get married at this time. Due to the above only, the present false case has been lodged to put pressure for marriage. Even if the allegations are taken to be true, it cannot be a case of rape. The girl is major. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,
Patna High Court Cr.Misc. No.43492 of 2017(4) dt.08-11-2017 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub Judge VII, Muzaffarpur in connection with Mahila P.S. Case No. 39 of 2017 corresponding to G.R. No. 2454 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
