The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 273, 291of the Indian Penal Code and 47(a) of the Excise Act. 15 kgs. of Mahua flower and 155 litres of country made liquor along with other manufacturing equipments were recovered from the manufacturing unit alleged to have been run by the petitioner. The petitioner escaped from the place of seizure.
It is submitted by learned counsel for the petitioner that there is nothing on the record to suggest that the place of seizure belongs to the petitioner.
Patna High Court Cr.Misc. No.55596 of 2015 (2) dt.08-12-2015 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the FIR has been registered in 2009, this Court is not inclined to grant anticipatory bail to the petitioner.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sigori P.S. Case No. 30 of 2009 pending in the court of learned Judicial Magistrate, Ist Class, Danapur, District - Patna.
