2. The petitioner has preferred this application for grant of regular bail in connection with Ghanshyampur P.S. Case No. 350 of 2024 registered for the offences punishable under Sections 96 of the BNS.

3. As per the prosecution case, on 19.10.2024, the minor daughter of the informant went to school but did not return home. Despite an intensive search, no trace of her could be found. It is further alleged that the informant got suspicion that one Bikau Kumar @ Pawan Khesari had kidnapped her daughter with ill intention.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Learned counsel for the petitioner, referring to the statement of the victim recorded under Section 183 of the BNSS, which was called for by the order dated 06.05.2026, submitted that the victim had a quarrel with her mother, after which she contacted a drama company. The members of company requested her to come to Darbhanga and facilitated her transportation by arranging a vehicle. Thereafter, she went to Darbhanga on her own, stayed with the drama company and performed drama for two days. Subsequently, the police reached Sitamarhi and took her to the police station. It has further been submitted that there is no allegation whatsoever against the petitioner in any manner.

It has also been submitted that this is a case of mistaken identity of the co-accused as the petitioner is not Bikau Kumar @ Pawan Khesari. It has further been submitted that the charge sheet has been filed against the petitioner and there is no allegation of tampering with the evidence against him. Lastly, it has been submitted that the petitioner has got clean criminal antecedent and he is in custody since 09.01.2026.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Darbhanga, in connection with Ghanshyampur P.S. Case No. 350 of 2024.

8. The application stands allowed.
