JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366, 366A, 372/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 19 years whereas the learned court below also assessed as such. In her statement under section 164 Cr.P.C. the victim has stated that she of her own went in the company of the petitioner and performed marriage with him, now she is carrying pregnancy of nine months.

Considering the 164 Cr.PC. statement of the victim, let

Patna High Court Cr.Misc. No.54473 of 2015 (2) dt.02-12-2015 2/2 the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Belsand P.S. Case No.50 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
