The petitioner seeks bail in connection with Akodhigola P.S. Case No.155/2020 instituted for the offences under Sections 341, 323, 302, 504, 506 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2020, charge-sheet has been submitted in this case and he has got one criminal antecedent, which is mentioned in para 3 of the bail application. Learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would manifest that the occurrence took place on account of dispute relating to land where it is alleged that this petitioner was also

It is also alleged that he abused the informant and the deceased but as far as killing of the brother of the informant is concerned the allegation is against co-accused, namely, Dharmdeo Sharma. The co-accused, namely, Motiharo Devi has been granted bail by this Court vide order dated 01.12.2021 in Cr. Misc. No.34350/2021.

Learned counsel for the informant as well as learned APP for the State opposes the bail application and submit that the petitioner was also present at the place of occurrence when the brother of the informant was killed by co-accused Dharmdeo Sharma.

Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Civil Court, Dehri-onSone, (Rohtas) in connection with Akhodhigola P.S. Case No. 155/2020.
