ANJANA MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Roh P.S. Case No.55 of 2014 for allegedly having committed the offences under Sections 341, 323, 447, 504, 307/34 of the Indian Penal Code and Section 3(1)(C)(F)(R)(S) of the S.C./S.T.(POA) Act.

Learned counsel for the petitioners submits that the provisions of S.C./S.T. Act has been brought in only to render the charge more grave. He further submits that, admittedly, the incident in question occurred inside the house of the informant and not at a public place. He further submits that there are no

Patna High Court Cr.Misc. No.57502 of 2015 (2) dt.11-01-2016 2/2 independent witnesses. It is further submitted that there is case and counter case between the parties and the injuries sustained on both sides.

Considering the nature of allegations and that there is a land dispute and also that the provisions of the S.C./S.T. (Prevention of Atrocities) Act are not attracted, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Roh P.S. Case No.55 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
