Prayer is for grant of anticipatory bail in Kalyanpur P.S. Case No. 145 of 2017 registered under sections 363 and 366 IPC.
According to the prosecution case, the victim, enticed away by the petitioner, was aged 16 years. Learned counsel for the petitioner, referring to the statement made in para 8 as well as the statement of the victim made under section 164 Cr. P.C. (Annexure-2), submits that she is aged about 18 years. Attention of the Court is also drawn to the statement of the victim girl (Annexure-2) wherein she has accepted of having left the place on her own volition and married with the petitioner. Learned counsel also submits,
Patna High Court Cr.Misc. No.2991 of 2018(2) dt.17-01-2018 2/2 referring to the statement made in para 7, that the victim was permitted to go to the matrimonial home by the learned Chief Judicial Magistrate, vide order dated 19.09.2017. Let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Kalyanpur P.S. Case No. 145 of 2017 on condition that one of the bailors shall be his own/close family member.
