The petitioner apprehends his arrest in connection with Jadia P.S. Case No. 134 of 2014, registered under Sections 302, 201 and 120B of the Indian Penal Code.
The accusation is that on receiving unknown male dead body sustaining firearm injury on 10.11.2014 near Nandana Madarsa, Jadia P.S. Case No. 134 of 2014 was instituted on 10.11.2014 against unknown.
Learned counsel for the petitioner submits that after lodging the present case on recovery of unknown dead body on 10.11.2014 on the basis of Fradbeyan of Choukidar. In
investigation, Anil Kumar Singh, identified the dead body as of his son, Sonu Kumar after postmortem, who also disclosed that his son left the house without information on 09.11.2014. But later on, he gave his statement to the effect that he came to know that his son, Sonu Kumar, had gone to the house of his maternal uncle in Sukhasan, fromwhere, he was accompanied by his friend including the petitioner. Thereafter, statement of Pawan Kumar Singh and Sanjay Singh, both maternal uncle of the deceased was recorded as detailed in paragraphs 21 and 23 of the case diary, in which they stated that Sonu Kumar was accompanied by his four friends including the petitioner. It is further submitted that, in fact, petitioner is the Ward Parisad at Purnia and due to political rivalry the name of the petitioner has been implicated in this case. Moreover, after identifying the dead body by Anil Kumar Singh, father of deceased, he gave an application to receive the dead body but he did not whisper about movement of his son with the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Jadia P.S. Case No. 134 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
