ANJANA MISHRA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. A supplementary show cause has been filed in Court today, in which it has been asserted that Award No.01/2016-17 for an amount of Rs.1,55,51,222/- (One crore fifty five lakh fifty one thousand two hundred twenty two only) has been passed on 27.03.2017 for payment of the compensation to the petitioner.

It appears from the earlier submission that the said amount was already deposited in the account of the Patna

Patna High Court MJC No.4731 of 2012 (17) dt.18-04-2017 2/2 High Court on 01.09.2016. It also appears from Challan No.107 dated 01.09.2016 that a sum of Rs.1,85,09,020/- (One crore eighty five lakh nine thousand and twenty only) has been deposited by the Special Land Acquisition Officer, Patna Flood Protection Scheme, Patna.

Let the amount of Rs.1,55,51,222/-(One crore fifty five lakh fifty one thousand two hundred twenty two only), as stated in the Award, be released in favour of the petitioner. The excess amount, which has been so deposited by the State authorities, should be returned back in favour of the Opposite Party No.2-Special Land Acquisition Officer, Patna Flood Protection Scheme, Patna.

The petitioner is directed to approach the office of the Registrar General along with a copy of the present order, who will take necessary steps for release of the amount in favour of the petitioner.

With the aforementioned direction, the present contempt application stands disposed of.
