JUSTICE SANJAY PRIYA ORAL ORDER 02-03-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in Naurangiya P.S. Case No. 27 of 2016 instituted for the offence under sections 302, 201, 120(B)/34 of the Indian Penal Code.
It is alleged in the written report that dead body of the husband of the informant was found at Donda river in village- Belahwa. The informant has raised suspicion that these petitioners and other accused persons had murdered her husband.
Patna High Court Cr.Misc. No.1630 of 2017 (3) dt.02-03-2017 The C.D. has been received.
The learned A.P.P. has pointed out the statement of the wife of the deceased (informant) recorded under section 164 Cr.P.C. as mentioned in para 43 of the C.D. wherein she specifically stated that she does not know who has killed her husband.
From the written report as well as statement of the victim, it appears that mere suspicion has been raised against these petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners are allowed. In the event surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Naurangiya P.S. Case No. 27 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bagaha, West Champaran, subject to the conditions as laid down under section 438(2) Cr.P.C.
