ANJANA MISHRA ORAL ORDER 09-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Madhuban P.S. Case No. 130/2016, registered for the offences punishable under Sections 363/366/366(A)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is neither named in the First Information Report nor in the statement recorded under Section 164 of the Cr. P.C. However, the name of the petitioner surfaced during the course of investigation and on the basis of such investigation, the petitioner is apprehending his arrest.

Having considered the entire facts and circumstances

Patna High Court Cr.Misc. No.16551 of 2018 (2) dt.09-04-2018 2/2 of the case and after perusal of the statement of the girl recorded under Section 164 Cr. P.C., it appears that the petitioner is being prosecuted on the basis of suspicion, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, East Champran, Motihari, in connection with Madhuban P.S. Case No. 130/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. , (Anjana Mishra, J) Saif/- U T
