The petitioners seek bail in a case instituted for the offences under Sections 414, 420, 467, 468 and 471 of the Indian Penal Code.

The prosecution case in short is that while the informant along with other police party were on patrolling duty, on seeing the police, the accused persons started fleeing away and were apprehended by the police and many currency along with A.T.M. cards etc. were recovered.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 14.2.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.24666 of 2019(3) dt.01-05-2019 2/2 against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case. No illegal gain has been made on the part of the petitioners nor any illegal loss has been created on the part of the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R. 17 A.T.M cards, 1 Adhar card, 1 Pan Card, some foreign currencies along with Rs. 3700/- are alleged to have been recovered from the possession of petitioner no. 1. 12 ATM card along with other articles are said to have been recovered from the possession of petitioner no. 2 and 8 ATM card along with other articles have been recovered from the possession of petitioner no. 3. Considering the nature of allegation, I am not inclined to grant bail to the petitioners in connection with Sangrampur P.S. Case No. 25 of 2019. The same is rejected. The Trial Court is directed to conclude the trial at the earliest preferably within eight months from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Pankaj/- U T
