JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-01-2020 The petitioner, a PDS licensee has challenged the order dated 06.03.2019 passed by the SubDivisional Officer, Hathua, Gopalganj whereby the license of the petitioner has been cancelled. From the bare perusal of the order impugned, it appears that the same has been passed mechanically. No reason has been assigned for rejecting the reply to the show-cause issued to the petitioner.

Such non-speaking order does not lead the

For the reason that the order is completely nonspeaking, this Court deems it expedient to set aside and sets it aside.

The matter is remitted to the Sub-Divisional Officer, Hathua, Gopalganj (respondent No. 4) for writing out a fresh reasoned order in accordance with law after affording an opportunity of hearing to the petitioner. This exercise must be completed within a period of six weeks of the receipt/production of a copy of this order.

With the aforesaid observation/direction, the writ petition stands disposed off.
