Vide order dated 16.12.2021, petitioner was directed to file a supplementary affidavit in this case but till date no affidavit has been filed.

The petitioner apprehends his arrest in a case in connection with Gaurichak P.S. Case No.214/2018, registered for the offence punishable under Sections 409, 420/34 of the Indian Penal Code. The allegation against the petitioner is that he has committed embezzlement of Government money of Rs.3,17,700/-, meant for implementation of different schemes. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence as

Patna High Court CR. MISC. No.27330 of 2020(9) dt.17-01-2022 2/2 alleged has ever taken place. It is submitted that the petitioner is ready to reconstruct the Additional Class Room (ACR). Petitioner is not involved in any embezzlement of the Govt. fund rather as per the direction for construction of once additional class room, half of the construction has already been done and raw materials for remaining construction is available there but without verification, petitioner has been implicated in this case. Petitioner has one criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail by submitting that there is specific allegation against the petitioner that he has done embezzlement of Rs.3,17,700/- of Govt. fund which was meant for construction of additional class room but till date, the same has not been constructed.

Having regard to the facts and circumstances of the case, I am not inclined to grant the anticipatory bail to the petitioner named above.

The prayer for anticipatory bail is rejected and the application is accordingly dismissed.
