The petitioner seeks bail in Dhaka P.S. Case No. 72/2018, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that during patrolling duty police reached at Nahar Pool of Village-Karsahiyasemra and intercepted some persons who were coming on bicycle with Bora. Seeing the police party they tried to run away leaving their bicycles but one person was caught with bicycle, who disclosed his name as Kamal Sah. Aforesaid Kamal Sah disclosed the name of petitioner and other accused persons who managed to escape. From the Bora of petitioner 45 litres of Nepali wine was recovered.

Patna High Court CR. MISC. No.24390 of 2019(2) dt.16-04-2019 2/2 Petitioner is in custody since 03.02.2018 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, East Champaran, Motihari, in connection with Dhaka P.S. Case No. 72/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
