JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-12-2020 Heard learned counsel for the petitioners and Ms. Nirmala Kumari, learned A.P.P. for the State. Petitioners in the present case are seeking regular bail in connection with Kanti P.S. Case No. 269 of 2020 registered for the offence under Sections 25(1-b)a/26/35 of Arms Act. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the case. Learned counsel submits that there is no recovery of the arms and ammunitions from the conscious possession of the petitioner. It is submitted that the petitioners are in custody since 16.05.2020 without there being any cogent material against them.

Patna High Court CR. MISC. No.27301 of 2020(4) dt.22-12-2020 2/2 Ms. Nirmala Kumari, learned A.P.P. for the State has opposed the prayer for regular bail of the petitioners. Having regard to the kind of weapons and ammunitions as also the quantum thereof recovered from the house of petitioner no. 2 and both these petitioners were found sleeping in the same room in which the arms and ammunitions were lying, this Court is not inclined to grant them privilege of regular bail at this stage.
