2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sonpur P.S. Case No. 943 of 2025 instituted for the offence under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of BNS.

3. The case of the prosecution is that the petitioner along with others has assaulted the informant while he was returning from Sonepur. It is alleged that this petitioner and one Neeraj assaulted with butt of the country made pistol.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel has submitted that the nature of allegation is general and omnibus and from perusal of the injury report, it

Patna High Court CR. MISC. No.26073 of 2026(2) dt.15-05-2026 2/2 transpires that the informant has received lacerated wound over parietal region of size 2cm x 2cm and the nature of injury is simple caused by hard and blunt substance.

5. In contra, learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of bail of the petitioner and has submitted that petitioner is having criminal antecedent of five cases.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Sonpur P.S. Case No. 943 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra subject to the conditions as laid down under section 482(2) of B.N.S.S.
