Heard counsel for the petitioner and counsel for the respondents-State.
Without availing remedy of appeal, petitioner is
Patna High Court CWJC No.16550 of 2011(5) dt.16-09-2019 2/2 assailing order of punishment of Collector, Muzaffarpur dated 17.08.2011.
Counsel for the respondents- State takes objection on account of alternative remedy available to the petitioner before Commissioner, Tirhut division, Muzaffarpur.
Being faced with such objection of counsel for the State, counsel for the petitioner submits that he would avail alternative remedy.
If petitioner presents appeal against the order passed by the Collector dated 17.08.2011, within a period of four weeks, respondent no.8 shall consider the same on its own merit without raising the issue of delay and dispose it of by reasoned and speaking order within three months thereafter. Writ petition is disposed of.
