JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is the informant of Khodabandpur P.S. Case No. 100 of 2012 registered for the offences punishable under sections 420 and 364 of the Indian Penal Code. The aforesaid case was investigated by the police. On conclusion of investigation, the police submitted final report under section 173(2) of the Code of Criminal Procedure in the court. The Magistrate concerned has accepted the final report. While investigation was still pending, the petitioner had also filed a protest petition in the court of the Magistrate concerned. After filing of the final report by the police in the aforesaid police case,
Patna High Court Cr. WJC No.1122 of 2013 (2) dt.09-01-2015 2/2 the Magistrate accepted the same and directed the protest petition to be registered as a complaint. The complaint case is still pending before the Magistrate.
In this background, the present writ petition has been filed under Articles 226 and 227 of the Constitution of India with a prayer to direct the respondent authorities to enquire into the matter relating to the aforesaid Khodabandpur P.S. Case No. 100 of 2012.
In my view, the application is totally misconceived. Accordingly, the writ petition is dismissed.
