JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioners and the State. The petitioners being sister, parents and brother in law of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A,323 and 307/34 of the Indian Penal Code.
The basic accusation is of torture and making attempt to strangulate the informant by putting dupatta around her neck. It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general. The thrust of accusation is against the husband of the victim and there is no injury report on record to suggest that any attempt on the life of
Patna High Court Cr.Misc. No.55637 of 2015 (2) dt.08-12-2015 2/2 the informant was made. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the thrust of accusation against the husband of the informant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Saran at Chapra, in connection with Sahajitpur P.S. Case No.68 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
