====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 07-05-2025 Heard Ms. Mukul Kumari, learned counsel appearing on behalf of the petitioner and Mr. Nityanand, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Madanpur P.S. Case No. 247 of 2023 registered for the offence punishable under Section 30(a), 34 and 36 of the Bihar Prohibition and Excise Act.

3. Allegation is of recovery of 420 litres of spirit from an unregistered pick up van bearing Chassis No. MA1ZN2GHKF1A11431 and Engine No. GHE1M73774.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and only on the basis of his criminal antecedent, he has been roped in a false case. He has no concern either with the seized liquor or trade of

Patna High Court CR. MISC. No.28202 of 2025(2) dt.07-05-2025 2/3 liquor in any manner. Petitioner is neither owner nor the driver of the said pick up van. He has been implicated in the case merely on suspicion.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the nature of allegation made against the petitioner, the learned District Court is directed to verify from the District Transport Officer concerned with regard to the ownership of the pick up van bearing Chassis No. MA1ZN2GHKF1A11431 and Engine No. GHE1M73774 and if it is found that the vehicle in question is not registered in the name of the petitioner and not a stolen one, then in that case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-I, Aurangabad in connection with Madanpur P.S. Case No. 247 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

7. The District Court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner

8. The bail application stands disposed of.
