The petitioner seeks bail in Aurai P.S. Case No. 51 of 2018, instituted for the offence under Section(s) 272, 273 of the Indian Penal Code, Sections 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner. As per seizure list, the recovery has been made from Dalan of Nagendra Rai situated in village Badaul kept beneath the Chauki. The name of petitioner has been disclosed by Chaukidar.
Petitioner is in custody since 26.2.2019.
Considering the aforesaid facts and circumstances of
Patna High Court CR. MISC. No.25370 of 2019(3) dt.24-04-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Aurai P.S. Case No. 51 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
