IN THE HIGH COURT OF JUDICATURE AT PATNA

Civil Writ Jurisdiction Case No.18645 of 2015 ====================================================== Binda Devi .... .... Petitioner/s

Versus

The State of Bihar & Ors .... .... Respondent/s ====================================================== Appearance :

For the Petitioner/s : Mr. Ravindra Kumar Singh For the Respondent/s : Mr. Ritesh Kumar- Sc33 ====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 27-01-2016 It appears that in this application, the State of Bihar has wrongly been made party. Accordingly, the name of respondent No.1, State of Bihar is deleted.

This application has been filed by the petitioner for setting aside the order dated 06.11.2015 passed by District Judge, Madhubani in Misc. Case No.15 of 2015 whereby the learned District Judge rejected the application filed by the petitioner for setting aside the order of transfer.

Perused the order passed by the Court below. It appears that the District Judge found that the Title Appeal No.14 of 2004 was transferred to another Court pursuant to the order of High Court in the administrative side. The appeal was also transferred in the administrative side. The District Judge, therefore, held that it is not possible to recall the said order.

In such view of the matter, since the order was passed

Patna High Court CWJC No.18645 of 2015 (2) dt.27-01-2016 transferring the appeal in administrative side, no question of interference in supervisory jurisdiction arises. Thus, this writ application is dismissed.
