JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 23-11-2016 The High Court is not willing to sit and do the accounting for the petitioner. If she was in-charge Headmaster of the school in question and certain advance was extended to her to complete the work of the school building and carry out mid-day meal scheme etc. then why she has been divested of her responsibility ? Now, there is an obligation upon her to account for every penny which she has received and utilized. The Court may not be willing to jump to a conclusion that it was a case of misappropriation and cheating but the accounting will have to be done at the field level and
Patna High Court CWJC No.8518 of 2014 dt.23-11-2016 2/2 verification thereof, will also be required to be made on the site. The District Education Officer, Sitamarhi is directed to accept the accounts which will be tendered by the petitioner. The petitioner has an obligation to sit with the District Education Officer and explain the accounts and the vouchers etc. and if accounting stands satisfactorily explained then steps will be required to be taken for payment of salary etc. to the petitioner. In the opinion of the court, three month's time should be enough, provided the petitioner fully cooperates in this exercise.
Writ is disposed of with the above observation and direction.
