2. The petitioner seeks bail in connection with Parbatta P.S. Case No. 14 of 2023 dated 21.01.2023, instituted for the offences punishable under Sections 420, 120(B) of the I.P.C. and 4, 5 and 6 of Immoral Traffic (Prevention) Act, 1956.
3. The prosecution case, in short, is that the accused persons were indulged in cheating the people on the assurance of providing them unmarried girls for solemnization of marriage.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel submits that specific allegation against the petitioner is that Rs. 25,000/- was given to the petitioner for solemnization of marriage. It is further submitted that the
Patna High Court CR. MISC. No.26890 of 2023(2) dt.25-05-2023 2/2 allegation against the petitioner is false and fabricated and nothing was paid to the petitioner. There is no proof of making payment to the petitioner. Learned counsel further submitted that one co-accused Komal Devi has been granted bail vide Criminal Miscellaneous No. 25103 of 2023 by a Co-ordinate Bench of this Court. Lastly, it has been submitted that the petitioner is in custody since 22.01.2023 having no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 3rd Naugachia, Bhagalpur in Parbatta P.S.
