JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Dehri (T) P.S. Case No. 507 of 2016 instituted for the offence under Sections 272, 273 of the Indian Penal Code, Sections 30, 38(i), 38(ii) and 41 of Bihar Prohibition and Excise Act..

As per written report huge quantity of foreign liquor has been recovered from the godown of the petitioner. It is mentioned in the seizure list enclosed with the First Information Report that total 90 cartons of Royal Stag foreign liquor (total 1000 bottles) containing 750 ml. each has been recovered from godown of this petitioner.

Therefore, seeing the recovery of huge quantity of foreign liquor from the godown of the petitioner, this court is not

Patna High Court Cr.Misc. No.54462 of 2017 (3) dt.06-12-2017 2/2 inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
