2. The petitioners are apprehending their arrest in connection with Lakhisarai P.S. Case No. 364/2024 dated 06.06.2024 registered for the offence punishable u/ss 302 and 201 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, when the informant was trying to talk to the daughter of her Lt. Sister-in-law through phone, other person who belonged to the family said that she has been killed and thrown away, "do whatever you want to do". Thereafter, the informant went to enquire about the
2/4 incident and came to know that Shambhavi Kumari (deceased) has been killed by the petitioners and the co-accused persons. In 2011, Lt. Sister-in-law of the informant was also killed by the petitioners, Anmol Singh and Ramashray Singh with other accomplice. Further, the informant has alleged that the coaccused persons and the petitioners had previously threatened to kill Shambhavi Kumari (deceased) over the phone and did not allow her to talk over phone.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Learned counsel has further submitted that the informant is not an eye witness of the alleged occurrence. Learned counsel has further submitted that the informant and the other witnesses have declared hostile and the photo copies of deposition are annexed as Annexure-P/3 with the bail petition. The petitioners have no concern with the alleged offence. The co-accused person has already been granted regular bail by this court vide order dated 18.01.2025 passed in Cr. Misc. No. 1129/2025. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. Learned counsel has further submitted that the petitioner no. 1 is a lady.

Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioners and submitted that the specific allegation against the petitioners is that they committed murder of the daughter of the informant's Lt. sister-in-law under conspiracy. Learned counsel has further submitted that as per the impugned order, the witnesses in para 3 and 4 have alleged that the petitioners are involved in the alleged offence.

Considering the aforesaid facts and circumstances of the case, let the petitioner no.1 namely, Rani Devi, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Lakhisarai in connection with Lakhisarai P.S. Case No. 364 of 2024, subject to conditions as laid down under section 482(2) of the B.N.S.S.
7. The application stands allowed with regard to the petitioner no.1 namely, Rani Devi.
8. So far as, the petitioner nos. 2 and 3 namely, Ramashray Singh and Anmol Kumar are concerned, considering the heinous nature of allegation made against them in the F.I.R.,
4/4 I am of the view that no case for grant of anticipatory bail is made out and the same is rejected with direction to the petitioner nos. 2 and 3 namely, Ramashray Singh and Anmol Kumar namely to surrender before the concerned Court below within six weeks from the date of this order and the learned Court below may consider his prayer for regular bail on its own merit in accordance with law without being prejudiced by this order.
9. Accordingly, the application regarding petitioner no.2 and 3 namely, Ramashray Singh and Anmol Kumar stands rejected.
