The petitioners apprehend their arrest in Naya Gaon P.S. Case No.5 of 2019 registered under Sections 147, 148, 149, 323, 307, 504 and 506 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant named the petitioners along with Ghanshyam Singh, Mukund Singh and others and alleged that they all having armed with different weapons came to the darwaza of the informant and began to abuse. The informant alleged that Bipin Singh, Ghanshyam Singh and Mukund Singh made indiscriminate firing and Ram Subhag Singh threatened the informant of dire consequence, if any information is given to the police station.

No.27937 of 2019(2) dt.30-04-2019 2/2 The learned counsel for the petitioners submits that present occurrence is alleged to have taken place on 17.01.2019 but prior to institution of the present case, Ram Subhag Singh, one of the accused filed Naya Gaon P.S. Case No.4 of 2019 on 16.01.2019 under Section 307 and other Sections of the I.P.C. and under Section 27 of the Arms Act. The present case is counter blast of the case lodged by one of the accused of the present case. It is further submitted that no specific allegation is made against the petitioners. The allegation of firing is made against Bipin Singh, Ghanshyam Singh and Mukund Singh.

Taking into consideration the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Begusarai in connection with Naya Gaon P.S. Case No.5 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
