2. It is the first regular bail application submitted by the petitioner who has been arrested in connection with Sahebpur Kamal P.S. Case No. 170 of 2024 for the alleged offences punishable under Section 302, 201, 120(B) and 34 of the Indian Penal Code.
3. In this case, the name of the deceased is Md. Shahzad, present applicant is the mother-in-law of the deceased, informant of the case is Shahnaz Khatoon who is the bhabhi of the deceased person. The dead body of Md. Shahzad was found hanging on 13.06.2024. The bhabhi of the deceased namely Md. Shahzad lodged the FIR alleging that the present applicant along
Patna High Court CR. MISC. No.25805 of 2025(2) dt.02-05-2025 2/3 with other co-accused persons and some unknown persons had murdered Md. Shahzad due to some previous dispute. During the course of investigation, the present applicant Pinki Khatoon was arrested on 28.01.2025.
4. It is submitted by the counsel for the petitioner that the petitioner is innocent and is falsely implicated in this case. There is no direct evidence available against her. It is further submitted that in this case there is no eye - witness and the present applicant is arrested only on the basis of suspicion. Lastly, it is submitted by the counsel for the petitioner that since she is in custody since 28.01.2025 and has no any previous criminal antecedent and the other co-accused persons Ajima Khatoon and Md. Sharif has also been granted benefit of bail by the Co-ordinate Bench of this Court vide Order dated 17.12.2024 passed in Cr. Misc. No. 73444 of 2024. Therefore, on these grounds the present applicant may also be granted benefit of bail.
5. Learned counsel appearing on behalf of respondentState opposes the prayer of bail.
6. Considering the submission made by the counsels and further considering the totality of the case. I am of the view that it is a case where this applicant should also be granted

The petitioner, above named, is directed to be released on bail in connection with Sahebpur Kamal P.S. Case No. 170 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties to the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
